# What well operations standards apply to offshore drilling under federal regulation? Answer in under 100 words. Cite only eCFR (www.ecfr.gov) sources.

Offshore drilling on the U.S. Outer Continental Shelf (OCS) is governed by 30 CFR Part 250, with § 250.400 mandating that all drilling operations be conducted safely to protect life, property, natural resources, and national security (as published at 81 FR 26017, Apr. 29, 2016). Operators must also follow Subpart G and § 250.107, which require safe workmanlike operations, use of Best Available and Safest Technology (BAST), and compliance with lease and permit terms.

## Details / How it works

30 CFR § 250.400 (General Requirements) requires OCS lessees and operators to conduct drilling in a safe manner to protect against harm to life (including aquatic life), property, OCS natural resources, national security, and the marine, coastal, or human environment, while also complying with Subpart G (30 CFR Part 250, Subpart G).

Under 30 CFR § 250.107, operators must perform all operations in a safe and workmanlike manner, maintain safe equipment and work areas, use recognized engineering practices that reduce risk to the lowest level practicable, and comply with all lease, plan, and permit terms. Operators must immediately control, remove, or correct any hazardous oil and gas accumulation or fire hazard.

The BSEE Director may require the use of Best Available and Safest Technology (BAST) on all new OCS drilling and production operations, and on existing operations where equipment failure would have a significant effect on safety, health, or the environment.

## Numbers & thresholds

| Provision | Requirement |
|---|---|
| 30 CFR § 250.400 | Safe drilling on the OCS; cross-references Subpart G |
| 30 CFR § 250.107(a) | Four-step duty: safe workmanlike operations; safe equipment/work areas; recognized engineering practices; compliance with lease/plan/permit terms |
| 30 CFR § 250.107(c)(1) | BAST required on all new OCS drilling and production operations and on existing operations unless waived |
| 30 CFR § 250.107(d) | BSEE authority to issue compliance, repair, inspection, and shut-in orders |
| 30 CFR § 250.1500 | Defines lessee, employee, contractor, well control, deepwater well control, production safety, and well completion/workover for OCS operations |

## Exceptions & edge cases

Under 30 CFR § 250.107(c)(2), conformance with BSEE's regulations is presumed to constitute use of BAST unless the BSEE Director determines otherwise. The BSEE Director may waive BAST for a category of existing operations or for a specific facility if the operator demonstrates that BAST is not practicable (30 CFR § 250.107(c)(3)). BSEE may also issue orders to shut-in a component or facility where there is a threat of serious, irreparable, or immediate harm, or where operations violate law, a regulation, an order, or a lease/plan/permit provision.
