# What is the VA's duty to assist veterans with their benefits claims? Answer in under 100 words. Cite only eCFR (www.ecfr.gov) sources.

Under 38 CFR 3.159, the VA has a duty to assist claimants in obtaining evidence needed to substantiate all substantially complete initial and supplemental claims. The VA will make reasonable efforts to obtain relevant records from Federal and non-Federal sources, and provide medical examinations or opinions when necessary to decide a disability compensation claim. The claimant must cooperate fully and provide enough information to identify and locate existing records.

## Details / How it works

**Scope of the duty.** The VA's duty to assist applies to all substantially complete initial and supplemental claims, and continues until the VA issues notice of a decision. Reasonable efforts include obtaining records from Federal agencies (e.g., Department of Defense, SSA, VA medical facilities) and non-Federal sources (state/local governments, private providers, employers).

**Claimant's role.** A claimant must cooperate fully, provide identifying information (custodian, time frame, condition treated), and authorize release of records when necessary.

**Medical examinations.** The VA will provide a medical examination or opinion when the record lacks sufficient competent medical evidence, but contains a current diagnosed disability, an in-service event/injury/disease, and an indication the disability may be associated with service.

**When assistance ends.** The VA will refrain from or discontinue assistance if there is no reasonable possibility it would substantiate the claim, including cases of ineligibility, inherently incredible claims, or claims barred as a matter of law.

## Numbers & thresholds

| Element | Standard |
|---|---|
| Federal records requests | As many requests as necessary; ended only if records do not exist or further efforts would be futile |
| Non-Federal records requests | Initial request plus at least one follow-up (unless initial response shows records do not exist or follow-up would be futile) |
| Notice response period (general) | 1 year from date of notice to provide information/evidence |
| Decision trigger after notice | VA may decide the claim after 30 days of no response |
| Readjudication trigger | If claimant submits evidence within 1 year after a decision made at 30 days, VA must readjudicate |
| Supplemental claim medical exam | Applies only if new and relevant evidence under § 3.2501 is presented or secured |

## Exceptions & edge cases

**No duty to provide § 3.159(b)(1) notice** arises upon receipt of: a supplemental claim filed within one year of a prior decision notice, a request for higher-level review, a Notice of Disagreement, or any claim where entitlement cannot be established as a matter of law.

**Reasonable-effits limits.** For non-Federal records, only one follow-up is generally required; a follow-up is not required if the initial response indicates records do not exist or that a follow-up would be futile.

**Inability to obtain records.** If reasonable efforts fail, the VA must give the claimant oral or written notice identifying the records, the efforts made, further action, and the claimant's ultimate responsibility to provide the evidence.

**Readjudication on return.** When a claim is returned by a higher-level adjudicator or the Board after a duty-to-assist error is identified, the agency of original jurisdiction must correct any other duty-to-assist errors not identified.
