1. Acceptance of Terms

Welcome to MIND AI ("MIND," "we," "us," or "our"), operated by Astra Way LLC. These Terms of Service ("Terms") govern your access to and use of our website at m-i-n-d.ai, our mobile applications for iOS and Android, our browser extensions, our developer API, our Model Context Protocol (MCP) server, and all related services (collectively, the "Service").

By creating an account, accessing, or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years of age (or 16 in the European Economic Area) to use the Service. If you are under the age of legal majority in your jurisdiction, you may use the Service only with the involvement of a parent or legal guardian. By using the Service, you represent that you meet these eligibility requirements.

3. Account Registration

• You must provide accurate, current, and complete information when creating an account.
• You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
• You agree to notify us immediately of any unauthorized use of your account.
• You may not create an account using another person's identity or impersonate any person or entity.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. Description of the Service

MIND is a personal AI platform built on a knowledge graph. The Service allows you to:

• Build a personal knowledge graph from documents, notes, journal entries, and web content.
• Query your knowledge graph using over 50 third-party AI models.
• Receive AI-generated insights, summaries, and action plans.
• Use browser extensions to save webpages and PDFs to your knowledge graph.
• Connect external AI agents to your knowledge graph via the Model Context Protocol (MCP).
• Access the developer API to build third-party integrations.

We may add, modify, or remove features at any time at our sole discretion.

5. User Content

5.1 Ownership

You retain all rights to the content you upload, create, or store on the Service ("User Content"), including documents, journal entries, knowledge graph data, thoughts, and any other content you contribute.

5.2 License to MIND

By submitting User Content, you grant MIND a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, display, and analyze your User Content solely for the purpose of providing and improving the Service for you. This license is limited to the operation of the Service. We do not use your User Content to train AI models, and we do not sell or share it with third parties for advertising purposes.

5.3 Your Responsibilities

You are solely responsible for the User Content you submit. You represent and warrant that:

• You own or have the necessary rights to submit your User Content.
• Your User Content does not violate any applicable law, infringe any third-party intellectual property rights, or violate the privacy of any person.
• Your User Content does not contain malware, viruses, or any harmful code.

6. Acceptable Use

You agree not to use the Service to:

• Violate any law or regulation, or infringe the rights of any third party.
• Upload or generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
• Upload or generate content that constitutes child sexual abuse material (CSAM), incites violence, or promotes terrorism.
• Impersonate any person or entity or misrepresent your affiliation with any person or entity.
• Attempt to gain unauthorized access to any portion of the Service, other accounts, or any computer systems or networks connected to the Service.
• Use any robot, spider, scraper, or other automated means to access the Service for any purpose without our express written permission, except via the official developer API or MCP server in accordance with their documented usage.
• Reverse engineer, decompile, or attempt to extract the source code of the Service, except as permitted by applicable law.
• Interfere with or disrupt the Service, the servers or networks connected to the Service, or the experience of any other user.
• Use the Service to generate, send, or facilitate spam, phishing, or any other unsolicited communications.
• Resell, rent, lease, or sublicense access to the Service without our prior written consent.
• Use the Service to compete with MIND, including by training a competing AI model or knowledge graph product on data extracted from the Service.

7. AI-Generated Content

The Service uses third-party AI models (including OpenAI, Anthropic, Google, Meta, and others) to generate responses, summaries, insights, and other content. You acknowledge and agree that:

• AI-generated content may contain errors, inaccuracies, or biases.
• AI-generated content is provided for informational purposes only and should not be relied upon as professional, legal, financial, medical, or other expert advice.
• You are responsible for verifying the accuracy and appropriateness of AI-generated content before relying on or acting on it.
• MIND does not warrant that AI-generated content will be accurate, complete, reliable, or fit for any particular purpose.
• You may not use the Service or AI-generated content to make decisions that have legal, financial, medical, or safety implications without independent professional verification.

8. Subscriptions, Credits & Payments

8.1 Subscription Tiers

The Service offers a Free tier and several paid subscription tiers (Starter, Professional, Business, Scale). Each tier provides different limits on credits, storage, and feature access. Current pricing and tier details are available on our website.

8.2 Credits

Credits are consumed when you make queries, upload documents, or perform other actions that consume third-party AI model resources. Credits do not expire while your subscription is active. Unused credits are not refundable in cash and cannot be transferred between accounts.

8.3 Billing

Paid subscriptions are billed in advance on a monthly or annual basis. Payments are processed by Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.

8.4 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period. You will retain access to paid features until the end of the billing period.

8.5 Refunds

Subscription fees are non-refundable except where required by applicable law. We may, at our sole discretion, issue refunds in exceptional circumstances.

8.6 Price Changes

We may change subscription prices at any time. We will provide at least 30 days' notice of any price increase. Your continued use of the Service after a price change constitutes acceptance of the new price.

9. Developer API & MCP Server

If you use our developer API or MCP server, you agree to additional terms:

• You must obtain an API key through your account settings and keep it confidential.
• You may not share, sell, or transfer your API key to third parties.
• You are responsible for all activity that occurs under your API key.
• You must comply with the rate limits and usage quotas associated with your subscription tier.
• You may not use the API to build a product that competes with MIND.
• We may revoke API access at any time for violation of these Terms.

10. Browser Extensions

If you use MIND browser extensions (Chrome, Safari, or otherwise), you agree that:

• The extension only sends data to MIND when you explicitly initiate a save action.
• The extension uses your authentication credentials only to access your MIND account.
• You are responsible for the content you choose to save, and for ensuring you have the right to save and process that content.
• The extension may be updated automatically through the respective browser's extension store.

11. Intellectual Property

11.1 MIND's Intellectual Property

The Service, including its software, design, logos, trademarks, content, and all underlying technology, is owned by Astra Way LLC and is protected by copyright, trademark, patent, and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal or internal business purposes in accordance with these Terms.

11.2 Trademarks

"MIND," "MINDsense," "MINDapp," and the MIND logo are trademarks of Astra Way LLC. You may not use these marks without our prior written consent.

11.3 Patent Notice

The Service is protected by pending patent applications covering the personal knowledge graph cognitive architecture, MINDsense emotional intelligence engine, and related technologies.

12. Third-Party Services

The Service integrates with third-party services, including AI model providers (via OpenRouter), payment processors (Stripe), authentication providers (Google, Apple), and infrastructure providers. Your use of these third-party services is subject to their own terms and privacy policies. We are not responsible for the practices of any third parties.

13. Termination

13.1 Termination by You

You may terminate your account at any time through your account settings or by emailing support@theastraway.com. Upon termination, your data will be deleted in accordance with our Privacy Policy.

13.2 Termination by MIND

We may suspend or terminate your account, with or without notice, if you violate these Terms, engage in fraud or abuse, or for any other reason at our sole discretion. We may also discontinue the Service entirely with reasonable notice.

13.3 Effect of Termination

Upon termination, your right to access the Service immediately ceases. Sections that by their nature should survive termination will survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

14. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MIND DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THAT AI-GENERATED CONTENT WILL BE ACCURATE, RELIABLE, OR FIT FOR ANY PARTICULAR PURPOSE. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.

15. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MIND, ASTRA WAY LLC, OR ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY OR (B) ONE HUNDRED U.S. DOLLARS ($100).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

16. Indemnification

You agree to indemnify, defend, and hold harmless MIND, Astra Way LLC, and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use of the Service, (b) your User Content, (c) your violation of these Terms, (d) your violation of any third-party rights, or (e) your violation of any applicable law.

17. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of New York, United States, without regard to its conflict of law principles. Any dispute arising out of or related to these Terms or the Service shall be resolved in the state or federal courts located in New York County, New York, and you consent to the personal jurisdiction of such courts.

Notwithstanding the foregoing, we may seek injunctive or other equitable relief in any court of competent jurisdiction to protect our intellectual property rights.

18. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page, updating the "Last Updated" date, and, where appropriate, sending you a notification. Your continued use of the Service after changes constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.

19. Miscellaneous

• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and MIND regarding the Service.
• Severability: If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
• No Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
• Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign these Terms at any time without notice.
• Force Majeure: We are not liable for any failure or delay in performance due to causes beyond our reasonable control.
