What electric rate schedules must be filed with FERC? Answer in under 100 words. Cite only eCFR (www.ecfr.gov) sources.

Under 18 CFR § 35.2 (as in effect per amendments through Order 755, Oct. 31, 2011), a rate schedule is a written statement of (1) electric service in interstate commerce or wholesale resale, (2) associated rates and charges, and (3) all classifications, practices, rules, or regulations affecting such service, designated with a Rate Schedule number. Any such rate schedule for electric energy subject to FERC's jurisdiction under the Federal Power Act must be filed with the Commission.

Definition of Rate Schedule

A rate schedule under 18 CFR § 35.2(b) is a written statement that includes:

  1. Electric service as defined in § 35.2(a) — the transmission of electric energy in interstate commerce or the wholesale sale of electric energy for resale in interstate commerce, including capacity, energy sales, and transmission services using public utility facilities;
  2. Rates and charges for or in connection with that service; and
  3. All classifications, practices, rules, or regulations affecting or relating to the service, rates, and charges.

The statement may take the form of a contract, purchase/sale agreement, lease, or other writing. Oral agreements forming part of the statement must be reduced to writing. Each rate schedule is designated with a Rate Schedule number.

What triggers the filing requirement

The rate schedule must be filed when it covers electric service that is subject to the Federal Energy Regulatory Commission's (FERC) jurisdiction under the Federal Power Act (16 U.S.C. 792 et seq.; Public Law 95-617; Public Law 95-91; Executive Order 12009).

Once filed, the filing date is the date on which the Secretary of the FERC receives all required supporting cost and other data (§ 35.2(d)), and the schedule generally becomes effective 60 days after the filing date unless the Commission specifies otherwise (§ 35.2(f)).

Rate Schedule vs. Tariff vs. Service Agreement

18 CFR § 35.2 distinguishes three related filings:

  • Rate schedule (§ 35.2(b)) — a written statement of electric service, rates/charges, and related classifications, practices, rules, or regulations, designated with a Rate Schedule number.
  • Tariff (§ 35.2(c)(1)) — a similar written statement, but offered on a generally applicable basis, designated with a Tariff Volume number.
  • Service agreement (§ 35.2(c)(2)) — an agreement that authorizes a customer to take electric service under a tariff, designated with a Service Agreement number.

All three are subject to FERC filing, posting, and service requirements under Part 35 and Part 385.
