Who qualifies as a parent or caretaker relative for Medicaid eligibility under 42 CFR 435.110? Answer in under 100 words.

Under 42 CFR 435.110 (last amended July 15, 2013), 'parents and other caretaker relatives' are defined by cross-reference to 42 CFR 435.4. The agency must provide Medicaid to these individuals and their spouse if living together, provided their household income is at or below the income standard established in the State plan, which is based on historical AFDC levels converted to MAGI-equivalent.

Details / How it works

Section 435.110 implements sections 1931(b) and (d) of the Act. The agency must provide Medicaid to parents and other caretaker relatives as defined in § 435.4, and to their spouse if living with them, when household income is at or below the income standard set in the State plan (paragraph (b)). The income standard is established by the agency in the State plan following the rules in paragraph (c).

Numbers & thresholds

Threshold Source
Minimum income standard State's AFDC income standard in effect as of May 1, 1988 for the applicable family size, converted to MAGI-equivalent under Secretary guidance (paragraph (c)(1)).
Maximum income standard The higher of: (i) The effective income level for section 1931 low-income families under the State plan as of March 23, 2010 or December 31, 2013, if higher, converted to MAGI-equivalent; or (ii) A state's AFDC income standard as of July 16, 1996, increased by no more than the percentage change in the CPI‑U between July 16, 1996 and the effective date (paragraph (c)(2)).

Exceptions & edge cases

The regulation covers the spouse of a parent or caretaker relative only if the spouse is living with that individual. Income standards must be converted to MAGI-equivalent using guidance issued by the Secretary under section 1902(e)(14)(A) and (E) of the Act. The minimum income standard cannot be lower than the May 1, 1988 AFDC level for the applicable family size.
