US FederalEPA Clean Air Act Title VI (Section 608)

Under EPA Section 608, what is the legal purpose of the refrigerant recycling rule and what devices count as an appliance? Answer in under 100 words.

Under 40 CFR 82.150 (issued Nov. 11, 2016), the rule's legal purpose is to reduce emissions of class I and class II refrigerants and their non-exempt substitutes to the lowest achievable level by maximizing recapture and recycling during maintenance, service, repair, and disposal of appliances, and by restricting sales of such refrigerants. Per 40 CFR 82.152, an "appliance" means any device that contains and uses a class I or class II substance or substitute as a refrigerant for household or commercial purposes—including air conditioners, motor vehicle air conditioners, refrigerators, chillers, and freezers—and each independent circuit in a multi-circuit system counts as a separate appliance.

Details / How it works

Per 40 CFR 82.150(b), the subpart applies to any person maintaining, servicing, repairing, or disposing of appliances containing class I, class II, or non-exempt substitute refrigerants, and also covers refrigerant reclaimers, technician certifying programs, appliance owners and operators, manufacturers of appliances and recovery/recycling equipment, approved testing organizations, and persons buying, selling, or offering to sell covered refrigerants.

Numbers & thresholds

Device category Defining threshold
Small appliance Fully manufactured, charged, and hermetically sealed in a factory with 5 pounds or less of refrigerant (refrigerators/freezers, room/window/portable ACs, packaged terminal air heat pumps, dehumidifiers, vending machines, drinking-water coolers)
MVAC-like appliance Mechanical vapor compression, open-drive compressor appliance with a full charge of 20 pounds or less, used to cool driver/passenger compartments of off-road vehicles (agricultural/construction equipment); not intended to cover R-22 appliances

Exceptions & edge cases

  • Multi-circuit systems: For a system with multiple circuits, each independent circuit is considered a separate appliance.
  • Exempt substitutes: Certain substances in listed end-uses—carbon dioxide, nitrogen, and water in any application; ammonia in commercial/industrial process refrigeration or absorption units; chlorine and hydrocarbons in industrial process refrigeration; ethane, propane, isobutane, and R-441A in designated uses—are exempt from the venting prohibition and the requirements of this subpart per §82.154(a)(1).
  • MVACs: Motor vehicle air conditioners follow separate rules under 40 CFR Part 82 Subpart B rather than this subpart's appliance servicing provisions.
